By accessing or using the EngineWhisper website (enginewhisper.com) and any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not use the Service.

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the revised Terms. We encourage you to review this page periodically.

EngineWhisper provides a remote vehicle diagnostic service. Users upload a short video of their vehicle's issue — such as an unusual noise, warning light, or visible symptom — and receive a professional diagnostic report prepared by certified German Master Mechanics ("Kfz-Meister").

The Service includes:

• A free safety check that tells you whether your vehicle is safe to drive.
• A paid full diagnostic report (priced between $19 and $39 per issue) that includes a detailed diagnosis, recommended repairs, and estimated costs.
• An optional monthly subscription ($49/month) that includes up to 3 full reports, priority service, and unlimited follow-up questions.

To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use of your account.

When you upload videos, images, or other content ("User Content") to the Service, you retain ownership of that content. However, by uploading, you grant EngineWhisper a non-exclusive, worldwide, royalty-free licence to use, store, process, and analyse your User Content for the following purposes:

• Providing the diagnostic service you requested.
• Improving our diagnostic accuracy and service quality.
• Training and improving our machine-learning and AI systems using anonymised or pseudonymised derivatives (e.g., extracted audio features, diagnostic patterns).

Original video files are removed from customer-facing systems within 90 days of report delivery unless you request earlier deletion. Please refer to our Privacy Policy for full details on data retention.

You represent and warrant that you have the right to upload all User Content and that it does not violate the rights of any third party.

The free safety check requires no payment. Full diagnostic reports are available on a per-issue basis at prices between $19 and $39, depending on the complexity of the diagnosis. Subscription plans are billed monthly.

All payments are processed through secure third-party payment providers (e.g., Stripe, PayPal). EngineWhisper does not store your credit card or banking details directly.

Prices are quoted in US Dollars and are subject to change. Any price changes will be communicated before taking effect and will not apply to orders already placed.

EngineWhisper provides remote diagnostic opinions based on video analysis. Our reports are prepared by qualified professionals and represent their best assessment of the information provided. However, please understand the following:

• Our service is not a substitute for an in-person vehicle inspection. Certain conditions can only be fully diagnosed by physically examining the vehicle.
• Diagnostic accuracy depends on the quality of the video and information you provide (lighting, audio clarity, angle, duration, etc.).
• We do not guarantee that our diagnosis will identify every issue with your vehicle.
• Cost estimates provided in reports are approximate and may vary depending on your location, parts availability, and chosen repair shop.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

To the maximum extent permitted by applicable law, EngineWhisper, its owner, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use of or inability to use the Service.
• Any decisions or actions you take based on information provided in our diagnostic reports.
• Any unauthorised access to or alteration of your account or content.
• Any vehicle damage, personal injury, or mechanical failure that occurs after receiving our report.

Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you paid to EngineWhisper in the twelve (12) months preceding the claim.

When recording videos of your vehicle for submission, you acknowledge and agree that:

• You will follow all safety precautions, including those described on our Tutorial page.
• Running engines have hot and moving parts that can cause injury. You assume all risk when recording near a running vehicle.
• You will never hold your phone while driving. Use a mount or ask a passenger to record.
• EngineWhisper is not responsible for any injury, damage, or accident that occurs during the recording of a video.

You agree not to use the Service to:

• Upload content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.
• Impersonate any person or entity or misrepresent your affiliation with a person or entity.
• Attempt to gain unauthorised access to the Service or its related systems.
• Use automated scripts, bots, or scrapers to interact with the Service without permission.
• Resell, redistribute, or commercially exploit our diagnostic reports without written permission.

All content, branding, design, text, graphics, and software on the EngineWhisper website — excluding User Content — is the property of EngineWhisper and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written consent.

Diagnostic reports delivered to you are licensed for your personal, non-commercial use only.

We reserve the right to suspend or terminate your account at our sole discretion, without prior notice, if we believe you have violated these Terms or engaged in conduct that could harm the Service or other users.

You may close your account at any time by contacting us at info@enginewhisper.com. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including disclaimers, limitations of liability, and intellectual property) will remain in effect.

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict-of-law provisions. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Saarbrücken, Germany.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
